The concept of human rights is a relatively recent phenomenon. Though earlier literatures on this issue are not wanting but only after the end of the Second World War the matter has acquired prominence. The relevant thinking however, may be traced so the concept of Natural law of the 17th century and it may be that this concept still finds sufficient mention in the judicial deliberations.

After concerted effort of prominent individuals and institutions the general assembly of UNO proclaimed its universal declaration of human rights on the 10th December 1948 .the declaration contains two broad category of rights, namely civil and political rights 2 economic social and cultural rights. By 1976, it was ratified by thirty countries and the universal declaration along with others came into being known as the international bill of rights, which constitutes the core of international human rights law (freeman; 2002; 45).

At present, it is expresses that every country should abide by the above and make requisite legal provisions by enacting appropriate laws and enforcement legal agencies. In spite of all these violation of human rights is rampant, it is often violated by the state, which has its duty to protect. The other type of violation often results from the dominant section or group of people, which vindicates the idea that in most cases the human rights are honored by violation rather than protection.
